Bargain for business?

I have just read Charles Denowh's guest opinion "Coronavirus shutdown exposes need for regulatory takings legislation in Montana" and must admit I am in awe of his ability to make a idea of the government taking certain actions to protect public safety and health is an example of "excessive" government regulation and thus triggers the need for compensation to [insert name of your favorite special interest group here].

If that is the bargain Mr. Denowh wants then I would propose the following: If a business does not wish to follow these types of rules, they are free to remain open and will freely and willingly assume all the liability in the event a customer or employee gets sick.
