An 18-year-old Butte man has been accused of sexually assaulting an underage girl at a residence on Oct. 12.

Trey Daniel Bennett, who turned 18 on Sept. 10, was arrested early Sunday morning and prosecutors charged him with sexual intercourse without consent the next day. He remained jailed Wednesday with bond set at $50,000.

Police say the assault occurred Saturday night at a Butte residence after the 15-year-old girl tried to leave the room but couldn’t. She reported the attack around 1:30 a.m. Sunday and was examined at St. James Healthcare.

Police have collected evidence in the case, and the girl underwent a forensic interview at the Child Evaluation Center in Butte.

Sexual intercourse without consent in this case is punishable by a minimum of two years in prison and maximum of life or 100 years, plus a fine up to $50,000. If the victim is younger than 16 and the offender is at least four years older, the minimum sentence is four years.
