A judge sentenced an Ogden, Utah man to three years in the Montana State Prison on Wednesday for attacking and choking a woman at a motel after she threw his bottle of Jack Daniels out the window.

District Judge Robert Whelan imposed the three-year term on 49-year-old John Allan Edwards but gave him 110 days credit for time already served in jail. He had been charged with strangulation of a partner or family member.

According to prosecutors, the two had been kicked out of the Days Inn in Butte on July 26 and ended up at the Quality Inn. The woman told police the two began arguing when Edwards wanted some “strange,” meaning another woman to have sex with them.

She also was upset he brought a bottle of Jack Daniels into their room, so she threw it out the window, knocking out the screen. He ultimately attacked her and choked her by putting his knee on her throat.

The door was cracked open and when police arrived, Edwards and the woman were naked and Edwards was standing over her with his hand pulled back as if he had just struck her, prosecutors say. The woman’s neck had abrasions and was starting to bruise.

Prosecutors recommended the three-year term in state prison and Kaitlyn Lamb, Edwards’ attorney, told Whelan they were OK with that. Edwards acknowledged there was no excuse for his behavior, she said.

Whelan said the sentence combined punishment with a chance of rehabilitation since it will include counseling for domestic violence.

“Hopefully upon release he will become a productive member of society,” the judge said.
