DEER LODGE - The probe by the state Division of Criminal Investigation continues in the death of a Deer Lodge man who was shot by a police officer Dec. 19.

Powell County Sheriff Scott Howard on Tuesday gave an update on the investigation and the two Deer Lodge police officers involved. Gavin Roselles returned to duty this week, and Eric Miller remains on paid administrative duty until the conclusion of the investigation, Howard said.

When the investigation is complete, Howard said, the report will be given to Powell County Attorney Lewis Smith for further action.

The incident stemmed from a 911 call from an armed suicidal man at a Deer Lodge home the night of Dec. 19. The officers who responded tried to negotiate with Nicholas Tyson Frazier, 29, but he pointed a gun at them, Howard said at a press conference Dec. 22.

Frazier died at the Deer Lodge hospital from his injuries. His services were held Jan. 3.
