DEER LODGE — A man who was injured during a gun fight with law enforcement officers in December was arraigned in Deer Lodge District Court Tuesday evening and charged with nine felonies.
Timothy Wayne Sweet, 46, of Deer Lodge was charged with: attempted deliberate homicide for firing shots from a handgun multiple times directly at Deer Lodge police officer Michael Schmidt; two counts of assault on a peace officer, causing Officer Schmidt apprehension of serious injury or death; and for shooting multiple times at Powell County Undersheriff Dale Forbes; two counts of criminal endangerment for shooting at Forbes and Powell County Deputy Kim Micu; and three counts of criminal mischief to property resulting in over $1,500 damage in each charge — multiple shots into the woman’s vehicle; multiple gunshots into the walls and furnishings in the house, and deliberately firing gunshots into the Deer Lodge police vehicle.
Sweet is in custody, but is not entitled to bond until a bond hearing can be held.
According to court records, Sweet and his girlfriend had been arguing the night before. When he returned to the residence the next day and found her gone he began shooting up the home they occupied using two` pistols. When law enforcement arrived, he fired multiple shots at them through windows in the house.
The record states that after one of Sweet’s shots struck the top and windshield of Schmidt’s police car behind which he was crouched, Schmidt returned the fire, firing one shot which struck Sweet in the arm. Officers provided first aid until taken by ambulance to the Deer Lodge Medical Center; he was later airlifted to a hospital in Missoula.
