A woman who had supervisor responsibilities at the Butte Pre-release Center faces a felony charge for allegedly having sexual intercourse with an inmate at the facility.
Brittany Popovich, 29, was charged this week in Butte Justice Court with a felony for having sex with the inmate on Oct. 20 and Nov. 5 last year at an apartment building at 205 W. Granite St. in Butte, according to court documents.
Under Montana law, an inmate can’t give consent to sexual contact with a supervisor at a correctional facility.
Popovich turned herself in earlier this week and is free on bond. A person convicted of sexual intercourse without consent faces a minimum sentence of two years in prison and a maximum of life behind bars. The maximum fine is $50,000.
Efforts to reach Mike Thatcher, who oversees the pre-release center for Community, Counseling and Correctional Services, by telephone through his office and cell numbers were not immediately successful.
